1. agreement
these terms govern your access to and use of the website at stayserene.com and any products or services offered by Stay Serene, Inc. (“we”, “us”, “our”). by using the site or placing an order, you agree to these terms. if you do not agree, please do not use the site or place an order.
2. eligibility
you must be at least 18 years old to purchase from us. by placing an order you represent that you meet this age requirement and have the legal authority to enter into this agreement.
3. your account
you are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. you are responsible for all activity that occurs under your account. please contact us immediately if you suspect unauthorized use.
4. products and pricing
we try to describe our products as accurately as possible, including ingredients, doses, and sourcing. prices and availability are subject to change without notice. we reserve the right to correct pricing errors and to limit, suspend, or cancel orders at our discretion (for example if a product is mispriced or out of stock).
5. orders and payment
when you place an order you authorize us to charge your selected payment method for the order total, including any applicable taxes and shipping. your order is not accepted until we send an order confirmation. we reserve the right to refuse or cancel any order for any lawful reason.
6. subscriptions (subscribe & save)
when you join subscribe & save, you authorize us to charge your selected payment method on the recurring cadence you select (for example every 30 days) at the discounted subscription price in effect at the time of each renewal, plus any applicable taxes and shipping. we will send a reminder before each renewal. you can pause, change cadence, change product, or cancel your subscription at any time before the next renewal date through your account or by emailing hello@stayserene.com. cancellation takes effect for future shipments and does not retroactively cancel orders already processed.
7. shipping and delivery
we currently ship within the United States. shipping costs and estimated delivery windows are shown at checkout. orders over $50 ship free in the contiguous U.S. risk of loss and title pass to you when the carrier accepts the package from us. delivery dates are estimates and not guarantees.
8. returns, refunds, and the sleep guarantee
better night sleep guarantee. if Serene Sleep does not produce a measurable change in your sleep within 60 nights of receipt of your first tub, contact us at hello@stayserene.com for a full refund of the purchase price of that first tub. the guarantee applies once per customer.
general returns. unopened products in resalable condition may be returned within 30 days for a refund of the product price (excluding shipping). opened products are non-returnable for hygiene and safety reasons, except as covered by the sleep guarantee. please contact support before sending a return.
9. health disclaimer
the statements made about our products on this site and on our packaging have not been evaluated by the U.S. Food and Drug Administration. our products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease. consult your physician before using any supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition. discontinue use and seek medical attention if you experience any adverse reaction. individual results vary.
10. intellectual property
the Stay Serene name, logos, product names, photography, copy, packaging design, and the website code and content are owned by Stay Serene, Inc. or our licensors and are protected by copyright, trademark, and other laws. we grant you a limited, revocable license to view the site for personal, non-commercial use. you may not copy, reproduce, distribute, modify, or create derivative works from any of our content without prior written permission.
11. user content
if you submit reviews, comments, photos, or other content to us or through the site, you grant Stay Serene a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and distribute that content in connection with our products and marketing. you represent that you own the content or have the right to grant this license, and that the content does not infringe any third-party rights.
12. acceptable use
you agree not to:
- use the site for any unlawful purpose or in violation of these terms.
- attempt to gain unauthorized access to the site, accounts, or systems.
- scrape, crawl, or use automated means to access the site beyond what is permitted by our robots.txt.
- resell our products without prior written authorization.
- post content that is defamatory, infringing, harassing, or otherwise harmful.
13. third-party links and services
the site may link to third-party websites and integrate third-party services. we are not responsible for the content, accuracy, or practices of those third parties, and accessing them is at your own risk.
14. disclaimers
the site and our products are provided on an “as is” and “as available” basis. to the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. we do not warrant that the site will be uninterrupted, error-free, or secure.
15. limitation of liability
to the fullest extent permitted by law, in no event will Stay Serene, Inc., its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or our products. our total liability for any claim arising from your purchase shall not exceed the amount you paid for the products giving rise to the claim.
16. indemnification
you agree to indemnify and hold harmless Stay Serene, Inc. and its officers, directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your violation of these terms, or your violation of any third-party right.
17. governing law and venue
these terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions. you and Stay Serene agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for any dispute not subject to the arbitration provision below.
18. dispute resolution
before filing any claim, you agree to first contact us in writing at hello@stayserene.com and attempt to resolve the dispute informally for at least 30 days. any unresolved dispute shall be settled by binding individual arbitration under the rules of the American Arbitration Association, except that either party may bring claims in small-claims court if they qualify. you and Stay Serene each waive any right to a jury trial or to participate in a class action.
19. changes to these terms
we may update these terms from time to time. material changes will be posted on this page with an updated date. your continued use of the site after the changes take effect constitutes your acceptance of the revised terms.
